Terms of Service

1. Acceptance of Terms
By downloading, accessing, or using Spinach ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Spinach is a mobile application that helps users discover vegan and vegetarian-friendly restaurants and venues. The App provides map-based exploration, venue information, ratings, and the ability to save favorites.
3. User Accounts
You may use the App without an account. Creating an account enables syncing saved venues across devices. You are responsible for:
- • Maintaining the confidentiality of your account credentials
- • All activities that occur under your account
- • Notifying us immediately of any unauthorized use
You may delete your account at any time through Settings in the App.
4. User Content
You retain ownership of any content you create in the App, such as saved lists and favorites. By using the App, you grant us a limited license to store and sync this content solely to provide the service to you.
5. Acceptable Use
You agree not to:
- • Use the App for any unlawful purpose
- • Attempt to gain unauthorized access to our systems
- • Interfere with or disrupt the App's functionality
- • Reverse engineer, decompile, or disassemble the App
- • Use automated systems to access the App without permission
- • Impersonate any person or entity
6. Venue Information Disclaimer
Venue information displayed in the App (including hours, menus, vegan options, and ratings) is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of this information. Always verify details directly with venues before visiting.
7. Intellectual Property
The App and its original content, features, and functionality are owned by Bartosz Filipowicz and are protected by applicable copyright and intellectual property laws.
8. Third-Party Services
The App uses third-party services including Google Maps. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- • The App will be uninterrupted or error-free
- • Defects will be corrected
- • The App is free of viruses or harmful components
- • Venue information is accurate or up-to-date
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past twelve months, if any.
11. Indemnification
You agree to indemnify and hold harmless Bartosz Filipowicz from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.
You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
